
Terms of Agreement for Mixing and Mastering Services
By submitting your booking form for Mixing or Mastering services, you (the "Client") agree to the following terms and conditions set forth by The Barn LLC ("Service Provider"). Please read the entire agreement carefully before finalizing your booking.
1. Scope of Services
- Mixing Services:
The Service Provider will mix the Client's song by balancing individual tracks/stems, applying EQ, compression, effects, and finalizing the overall sound. The goal is to achieve a polished, professional-sounding mix based on the Client's preferences and requirements.
- Mastering Services:
The Service Provider will master the Client's song by enhancing the final stereo mix, ensuring optimal sound across various listening environments (e.g., streaming, radio, CD). This process includes tonal adjustments, loudness maximization, and preparing the track for distribution.
2. Submission of Files
- The Client agrees to submit high-quality files in the formats specified by the Service Provider (e.g., .WAV, .AIFF, .MP3, .FLAC).
- The Client must provide all necessary files, including:
- For Mixing: Track stems, any reference tracks, and detailed instructions.
- For Mastering: The final stereo mix (non-limited version), and optionally, reference tracks.
- Files must be properly labeled and free from technical issues. The Service Provider is not responsible for delays or errors caused by improperly submitted files.
3. Timeline and Delivery
- Rush Orders:
- Rush service may be available upon request for an additional fee. The Client should confirm availability with the Service Provider before booking.
- Delays:
- Delays in file submission, feedback, or payment will result in a delayed project completion. The Service Provider is not responsible for delays caused by the Client.
4. Revisions
- Mixing:
- The Client is entitled to selected revision rounds for the mixing process. Revisions are limited to adjustments in balance, EQ, effects, and overall mix quality.
- Additional revisions outside the agreed scope will be charged at a fee of $50.00 per.
- Mastering:
- The Client is entitled to selected revision rounds for the mastering process. Revisions typically include adjustments to loudness, tonal balance, and clarity.
- Additional revisions outside the scope will incur a fee of $50.00 per additional revision.
5. Payment Terms
- Pricing:
- The Client will be charged the agreed-upon price as indicated in the booking form. Prices are subject to change and should be confirmed at the time of booking.
- Deposit:
- A 50% deposit is required to secure the project. The remaining balance is due upon project completion, before receiving final files.
- Payment Methods:
- The Client agrees to pay via bank transfer, PayPal, credit card, etc.]. Payments must be completed in full before the final delivery of the mixed or mastered track.
- Late Payment:
- Late payments will incur a 10% late fee for each day past the agreed. The Service Provider reserves the right to withhold final files until the balance is paid.
6. Copyright and Ownership
- Client Ownership:
- The Client retains full ownership of their music and all rights to the original and final compositions. This includes all intellectual property rights related to the work.
- Service Provider Usage:
- The Service Provider retains the right to use excerpts of the final mixed or mastered track for promotional purposes (e.g., portfolio, website, social media) unless the Client requests otherwise in writing.
7. Client Responsibilities
- Accurate Information:
- The Client is responsible for providing accurate information and ensuring all files are submitted correctly (e.g., labeled stems, reference tracks, etc.).
- Approval:
- The Client is responsible for reviewing and approving the final mix or master within a reasonable time frame. After approval, no further changes will be made.
8. Confidentiality
- The Service Provider agrees to maintain the confidentiality of all Client files, tracks, and personal information. Files will not be shared with third parties without the Client's explicit written consent.
9. Cancellations and Refunds
- Cancellation by Client:
- The Client may cancel the project at any time before work begins. If the Client cancels after work has commenced, the deposit will not be refunded.
- If work is 50% or more complete, the Client agrees to pay for the work completed up to that point.
- Refunds:
- No refunds will be issued for completed or approved projects, except in the case of a proven error on the Service Provider’s part.
10. Limitation of Liability
- The Service Provider is not liable for any issues arising from the distribution, promotion, or commercial use of the final mix or master.
- The Service Provider will not be responsible for any damage, loss, or costs incurred by the Client due to the use of the final product.
11. Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of United States of America, Florida. Any disputes will be resolved in the appropriate courts of Orange County, Florida.
12. Agreement Acceptance
By submitting this form, you confirm that you have read and understood the terms and conditions outlined above and agree to abide by them.
